User Agreement
This Terms of Use Agreement sets forth the standards of use of the SanAntonioRemodelersonline.com (here in also referred to as SARO) Online Service. By using the SanAntonioRemodelersonline.com website you (the "User") agree to these terms and conditions. If you do not agree to the terms and conditions of this agreement, you should immediately cease all usage of this website. We reserve the right, at any time, to modify, alter, or update the terms and conditions of this agreement without prior notice. 1. Description of Service
SanAntonioRemodelersonline.com is providing the User with information regarding general contracting, and associated services. SanAntonioRemodelers.com is a “referral” service and endeavors to pair qualified remodeling contractors with qualified buyers.
2. Disclaimer of Warranties
You acknowledge and agree that the SanAntonioRemodelersonline.com services are provided to you on an "AS IS" basis without any warranty whatsoever, and your sole and exclusive remedy, and SARO's sole obligation to you or any third party for any claim arising out of your use of the SARO services or the SARO Web site, is that you are free to discontinue your use of the SanAntonioRemodelersonline.com services or the SanAntonioRemodelersonline.com Web site at any time.
EXCEPT AS EXPRESSLY SET FORTH HEREIN, SANANTONIOREMODELERSONLINE.COM EXPRESSLY DISCLAIMS ANY IMPLIED WARRANTIES OF ANY KIND, INCLUDING, BUT NOT LIMITED TO, WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE, AND YOU AGREE THAT SANANTONIOREMODELERS.COM SHALL HAVE NO LIABILITY FOR DIRECT, INDIRECT, SPECIAL, INCIDENTAL, CONSEQUENTIAL (INCLUDING LOST PROFIT), EXEMPLARY OR PUNITIVE DAMAGES (EVEN IF SANANTONIOREMODELERS.COM HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES) ARISING OUT OF THIS AGREEMENT OR ANY CONSEQUENCES WHICH FLOW FROM IT. SOME STATES AND PROVINCES DO NOT ALLOW LIMITATIONS ON OR EXCLUSION OF INCIDENTAL OR CONSEQUENTIAL DAMAGES. IN SUCH STATES AND PROVINCES, THE ABOVE EXCLUSIONS MAY NOT APPLY TO YOU.
The Terms and Conditions will inure to the benefit of SARO 's successors, assigns and licensees. If any provision of these Terms and Conditions shall be deemed unlawful, void or unenforceable, for any reason, by any court of competent jurisdiction that provision shall be modified in order to make it enforceable, while maintaining the spirit of the provision. Alternatively, if modification is not possible, such provision shall be stricken and shall not affect the validity and enforceability of the remaining terms. The failure of SARO to exercise or enforce any right or provision of the Terms and Conditions shall not constitute a waiver of such right or provision.
3. Limitation of Liability
SANANTONIOREMODELERSONLINE.COM SHALL NOT BE LIABLE FOR ANY DAMAGES WHATSOEVER, AND IN PARTICULAR SANANTONIOREMODELERS.COM SHALL NOT BE LIABLE FOR ANY SPECIAL, INDIRECT, CONSEQUENTIAL, OR INCIDENTAL DAMAGES, OR DAMAGES FOR LOST PROFITS, LOSS OF REVENUE, OR LOSS OF USE, ARISING OUT OF OR RELATED TO THIS WEB SITE OR THE INFORMATION CONTAINED IN IT, WHETHER SUCH DAMAGES ARISE IN CONTRACT, NEGLIGENCE, TORT, UNDER STATUTE, IN EQUITY, AT LAW, OR OTHERWISE, EVEN IF SARO HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. SOME JURISDICTIONS DO NOT ALLOW FOR THE LIMITATION OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES, THEREFORE SOME OF THE ABOVE LIMITATIONS ARE INAPPLICABLE.
4.Indemnification
User agrees to indemnify and hold SanAntonioRemodelersonline.com, its parents, subsidiaries, affiliates, officers and employees, harmless from any claim or demand, including reasonable attorneys' fees and costs, made by any third party due to or arising out of User's use of the Service, the violation of this Agreement, or infringement by User, or other user of the Service using User's computer, of any intellectual property or any other right of any person or entity.
5.Modifications and Interruption to Service
SanAntonioRemodelersonline.com reserves the right to modify or discontinue the Service with or without notice to the User. SARO shall not be liable to User or any third party should SanAntonioRemodelers.com exercise its right to modify or discontinue the Service. User acknowledges and accepts that SARO does not guarantee continuous, uninterrupted or secure access to our website and operation of our website may be interfered with or adversely affected by numerous factors or circumstances outside of our control.
